1. Overview

Asher Creative Studio LLC, a Utah limited liability company ("Asher Creative Studio," "we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit ashercreativestudio.com, submit an inquiry, schedule a consultation, request or purchase services, enter a client relationship, or interact with our related forms, documents, invoices, and client tools (collectively, the "Services").

By using the Services, you acknowledge the practices described in this Privacy Policy. If you do not agree, please do not provide personal information through the Services.

2. Information We Collect

The information we collect depends on how you interact with us. We may collect the following categories:

  • Contact information, such as your name, business name, email address, telephone number, mailing address, and preferred method of contact.
  • Project and business information, such as your website goals, industry, audience, branding preferences, services, budget range, timeline, current website, domain information, and questionnaire responses.
  • Client content and files, such as copy, logos, photographs, videos, testimonials, brand assets, account invitations, and other materials supplied for a project.
  • Transaction and billing information, such as selected services, proposal and contract status, invoice details, payment status, transaction identifiers, and billing records. Payment-card and bank-account information is generally collected directly by our payment processor rather than stored by us.
  • Communications, such as emails, form submissions, consultation notes, client-portal messages, feedback, revision requests, and customer-support communications.
  • Technical and usage information, such as IP address, browser type, device type, operating system, referring pages, pages viewed, approximate location derived from IP address, dates and times of access, and interactions with the Website.
  • Cookie and similar-technology information, where cookies, pixels, local storage, analytics, or comparable technologies are enabled.

Please do not send passwords, Social Security numbers, government-identification numbers, medical information, full payment-card details, or other highly sensitive information through a general inquiry form or ordinary email. If account access is needed, use an approved invitation, delegated-access feature, or secure method requested by us.

3. Sources of Information

We may obtain information directly from you; automatically from your browser or device; from people authorized to act for your business; from referral sources; and from service providers that support our website, scheduling, email, client management, proposals, contracts, invoicing, payments, analytics, file storage, and communications. We may also review information your business has made publicly available when preparing for an inquiry or project.

4. How We Use Information

We may use personal information to:

  • respond to inquiries and determine whether our services are a suitable fit;
  • schedule consultations and communicate about potential or active projects;
  • prepare recommendations, estimates, proposals, contracts, invoices, and project plans;
  • provide website design, integrations, domain assistance, email-setup assistance, maintenance, and support;
  • manage revisions, files, approvals, payments, accounting records, and the client relationship;
  • operate, maintain, secure, troubleshoot, and improve the Website and Services;
  • understand Website usage and evaluate marketing effectiveness where analytics are enabled;
  • send service-related notices and, where permitted, marketing communications;
  • prevent fraud, misuse, security incidents, and violations of our agreements; and
  • comply with legal, tax, accounting, insurance, dispute-resolution, and recordkeeping obligations.

5. How We Disclose Information

We may disclose personal information only as reasonably necessary for the purposes described in this policy, including to:

  • service providers supporting website hosting and deployment, cloud storage, email, forms, scheduling, client management, electronic signatures, invoicing, payments, accounting, analytics, security, and customer support;
  • independent contractors or professional advisers who need the information to provide authorized services and are expected to protect it appropriately;
  • government authorities, courts, regulators, law enforcement, or other parties when required by law or reasonably necessary to protect rights, safety, property, or the integrity of the Services;
  • a purchaser, successor, lender, adviser, or other participant in a merger, financing, reorganization, sale, or transfer of all or part of our business, subject to appropriate safeguards; and
  • other parties when you direct us to disclose the information or provide consent.

We do not currently sell personal information for monetary consideration. We do not knowingly use or disclose personal information for targeted advertising across unrelated businesses. If these practices change, we will update this policy and provide any notices or choices required by applicable law.

6. Service Providers and Third-Party Tools

Our Services may rely on third-party providers for website hosting, domain services, business email, forms, scheduling, client portals, proposals, contracts, invoicing, payments, accounting, file storage, analytics, and communications. These providers process information under their own terms and privacy notices and may operate in different locations.

Our current business tools may include Lovable for website hosting and related functionality, Bonsai for client and financial workflow, Zoho or another provider for business email and domain services, and approved payment processors. This list may change as our business tools change. A link to or integration with a third-party service does not mean that we control that provider’s privacy or security practices.

7. Payments

Payments are processed by an approved third-party payment provider. We generally receive limited transaction information—such as payer name, invoice, amount, payment status, date, and transaction identifier—rather than complete payment-card or bank credentials. Your payment provider’s privacy policy governs the information it collects directly. Do not send full payment credentials by email or through a general contact form.

8. Cookies and Analytics

The Website may use cookies and similar technologies necessary for functionality, security, preferences, forms, and session management. If analytics or other optional technologies are enabled, they may collect information about how visitors find and use the Website.

You can control many cookies through your browser settings and, where provided, our cookie-preference tool. Blocking cookies may affect Website functionality. We will use a consent banner or other choice mechanism when required by applicable law. We will respond to recognized browser-based opt-out signals, such as Global Privacy Control, to the extent required and technically supported.

9. Email and Text Communications

We may send communications needed to respond to inquiries, provide services, deliver documents, send invoices, confirm appointments, request project materials, and provide support. If you receive promotional emails, you may unsubscribe through the message or contact us. Unsubscribing from marketing does not stop necessary transactional or project communications.

If text messaging is used, message and data rates may apply. We will request any consent required by law before sending recurring marketing texts.

10. Data Retention

We retain information for only as long as reasonably necessary for the purposes described in this policy, including providing services, maintaining business and tax records, enforcing agreements, resolving disputes, preventing fraud, and satisfying legal obligations. Retention periods vary by the type of information and relationship. When information is no longer reasonably needed, we may delete, anonymize, or securely dispose of it, subject to backup cycles and legal holds.

11. Data Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information we handle. However, no internet transmission, email system, platform, or storage method can be guaranteed completely secure. You are responsible for safeguarding your own account credentials and promptly notifying us if you suspect unauthorized access involving a project account or shared material.

12. Your Privacy Choices and Rights

Depending on where you live and whether a particular privacy law applies, you may have rights to request access to, correction of, deletion of, or a copy of certain personal information; to opt out of certain sales, targeted advertising, or profiling; or to appeal a decision regarding a privacy request.

To submit a request, email hello@ashercreativestudio.com with the subject “Privacy Request” and describe your request. We may need to verify your identity and authority before responding. Authorized agents may be required to provide proof of authorization. We will not discriminate against you for exercising applicable privacy rights. Some information may be exempt from a request or retained when required for contracts, security, taxes, legal compliance, or legitimate business records.

You may opt out of promotional email using the unsubscribe mechanism provided or by contacting us. You may manage cookies through your browser and any cookie-preference tool available on the Website.

13. Children’s Privacy

The Services are intended for adults and businesses and are not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child has provided personal information to us, contact hello@ashercreativestudio.com so we can review and delete it as appropriate.

14. Third-Party Websites and Social Media

The Website may link to social-media pages, client websites, scheduling pages, payment pages, or other third-party services. We are not responsible for the content, availability, privacy, or security practices of those third parties. Review their notices before providing information.

15. Visitors Outside the United States

Asher Creative Studio is based in Utah, United States. If you access the Services from another country, your information may be transferred to and processed in the United States or other locations where our service providers operate. Those locations may have different privacy laws than your home jurisdiction. Additional notices or consent may be required before we intentionally market to or serve individuals in certain countries.

16. Changes to This Privacy Policy

We may revise this Privacy Policy when our practices, services, providers, or legal obligations change. We will post the revised policy with an updated “Last updated” date. If required by law, we will provide additional notice or obtain consent for material changes.
